The New York State Department of Labor rule that increases overtime exempt salary thresholds for New York employees is now in effect as of December 31, 2016. Employers in New York must comply with the new overtime salary thresholds as outlined in the chart below.

While the U.S. Department of Labor’s proposed rule to increase the national overtime exempt salary threshold is still under a nationwide preliminary injunction, this has no effect on the effective date of the New York State rule. The national threshold is set to be decided in the first half of 2017.
